At A&A we effectively resolve domain disputes, while protecting trademarks, and distinctive company and celebrity names and slogans, from global business interference.

We have sucessfully negotiated the sale and transfer of nearly one hundred disputed domain name registrations and have handled Federal litigation brought under the Anti-Cybersquatting Consumer Protection Act. (ACPA).

We are adept at dealing with domain dispute arbitration proceedings under the ICANN Uniform Domain Name Resolution Policy (UDRP) in matters before the National Arbitration Forum (NAF), the World Intellectual Property Organization (WIPO), in Canada - CIRA.org and under the United Kingdom's NOMINET policy. We have been succesful in many cases, both recovering Complainants'  "cybersquatted" domain names registered in bad faith, as well as defending Respondents' rights in cases of reverse-domain hijacking.

Domain Names, Company Names, Brand Names, Celebrity names, family names, generic trade names, trademarks, servicemarks, appellations, serial marks, collective marks: When an individual or company markets his or her goods or services in a way to stand out from the rest of the traders, and thereby gains a reputation and goodwill - that is when TRADEMARK rights begin.

When an domain registrant markets goods and services online, they may gain trademark rights - and/or they may infringe on the sound or spelling of a prior trademarked use.

When a famous celebrity or trademarked name is registered as a domain name in any one of hundreds of registries worldwide, sparks are likely to fly.  We have helped to recover several such names including BOBCRANE.ORG, JOHNHOLMES.COM and GALEHAROLD.NET.  Indeed, A&A assists celebrities, companies and even start-ups with saving their names and related keywords. FREQUENTLY ASKED QUESTIONS
INTERNET LAW

WHAT ARE KEYWORDS?
Words that describe a product or service such that a person who puts those words into a search engine, may find sites that meet the desired criteria.

WHAT IS KEYWORD INFRINGEMENT?
For example, one frequently infringed Internet keyword is "PLAYBOY" (another is "PLAYMATE"). Hugh Hefner's legacy was to build up the value of these words in their trademark sense; that is to say, that the public can distinguish Mr. Hefner's goods and services from other traders; and now as a result, Internet search engines can find his company sites by using the protected Keyword "PLAYBOY."

Keyword infringement often occurs when another adult site with no affiliation to Mr. Hefner's company submits the keyword PLAYBOY and/or PLAYMATE to a search engine as a suggested word that describes its own, unrelated goods and services.

WHAT ARE META TAGS?
"Meta Tags" are HTML code that often invisibly performs the same function as a keyword, but in a more "behind the scenes" way. Meta Tags are secret code words that are embedded on an Internet web site which are also meant to be descriptive of the site's contents. For example, the words "brand names, trademarks, copyrights, trademark lawyers, and domain names" are among the "meta tags" embedded on this page. The meta tags are designed to help many of the search engines to classify and rank web pages according to how likely the useful results might occur on a given site.

Though it is a widespread practice, when a web pirate uses another person's trademark in their meta tags without permission, such act will most likely be an illegal infringement of the rights of the trademark holder.

The good news, is that META TAG piracy, like cybersquatting and hyperlinking, can be ferreted out and need not be tolerated.

As part of a global solution for the New Millennium, A&A can eliminate Keyword and Meta Tag infringement, unwarranted hyperlinking and domain hijacking.
